Dear all: According to copyright laws or consumer consumption, ICANN would be providing a service. These laws are mandatory in all countries or that you can not waive your application. The service user is a consumer, is third which is not part of the contract. The third is the beneficiary of that contract. The laws establish the liability of the supplier (in this case ICANN) for the service to the end user (in this case the third party will use the domain name) But these laws protect end users, not when service users are commercial enterprises.
