I'd like to clarify what happened in the Domino's case.

Essentially, the case changes nothing,  but it confirms a great deal.  It has been widely accepted over the last several years that website accessibility violations are a violation of the Americans with Disabilities Act. As a matter of fact, over 2,500 lawsuits were filed alleging web accessibility violations, most by blind or visually impaired plaintiffs.  This year, the US is on track to see over 3,000 such lawsuits.  Nearly all of these suits settle quickly, with a settlement that largely goes to the law firm and not the plaintiff.

Recent cases where defendants challenged the application of the ADA to websites have almost all been lost by the defendants.  So, this case is neither novel nor surprising.  What is important is that until now, the issue had not been tested at the Supreme Court.  By letting the lower court decision stand, the Court signaled that the case was correctly decided and that the decision raised no novel or complex issues.

Best regards,

Greg

e-Accessibility (i.e. accessibility in the context of ICTs, web and Internet) aims to enable access to electronic products and services for all people, including specifically persons with disabilities and persons with specific needs. Providing accessibility by design will allow inclusion with consequent impact on better equality and income distribution, as well as economic opportunities in the digital space to companies globally.

With the uptake of global, regional and national legislative regulations on accessibility, enterprises offering ICT products and services are facing the need to properly address e-accessibility in their offerings and to suitably address customers with disabilities and persons with specific needs.

Several International standards exist already which address e-accessibility by providing technical solutions.

This webinar is offered to provide a better understanding of the requirements including key regulations on e-accessibility. The webinar will investigate the activities, results and plans of international standards setting organizations and shed insights into their e-accessibility standards as relevant in the context of e-business.

In particular, the webinar will address and focus specifically on the following topics/themes from a standardization perspective:

  • legal framework (e.g., EU) on e-accessibility,
  • e-procurement and public e-procurement;
  • accessible user interfaces and accessible content,
  • e-accessibility in the context of broadcasting,
  • certification for e-accessibility and systems,
  • aspects of users on usability for e-accessibility.

The target audience of the webinar should be standard managers, technical project managers (TPMs), and interested experts among the membership of the involved organizations.

That’s a good Judith,

I have been a volunteer for the UN e-governance survey and accessibility of websites by the disabled was one of the things looked out for.  Past results of the survey can be found in this url:

From this I’m sure disabled accessibility is a requirement, hence this is a good ruling.

Hi All,

Just saw this on Facebook. The US Supreme Court refused to opine on a ruling
letting the past ruling by the lower courts stand. That ruling found against
Dominoes because its website was not accessible. This law now allows blind
people to sue retailers if their websites are not accessible,
https://www.latimes.com/politics/story/2019-10-07/blind-person-dominos-ada-supreme-court-disabled

The law says that the Americans With Disabilities Act protects access not just
to restaurants and stores but also to the websites and apps of those businesses.
This is a big win for accessibility.
